Copyright & Intellectual Property Policy

1. EU Notice & Action (Primary)

Pigona respects the intellectual property rights of others and expects its users to do the same. Pursuant to Article 16 of the Digital Services Act (EU 2022/2065) and § 6 DDG, you may submit a notice of allegedly infringing or illegal content by contacting us at support@pigona.com with the following information:

  • Identification of the copyrighted work that you claim has been infringed, or a representative list if multiple works are affected.
  • Identification of the material that you claim is infringing and information sufficient to permit us to locate it (e.g., Discord Message Links, Server IDs, channel names).
  • Your contact details: name, email address, and postal address.
  • An explanation of why you consider the content to be infringing or illegal.
  • A statement that you believe in good faith that the use of the material is not authorized by the rightholder, its agent, or the law.

We will act expeditiously upon receiving a substantiated notice and inform both the notifier and the affected user of our decision.

2. Liability Exemption

Pigona operates as an automated conduit for user-initiated translations. Pursuant to Art. 5 DSA (mere conduit) and § 8 DDG, we are not liable for third-party content transmitted through our service, as we do not initiate the transmission, select the receiver, or select or modify the information transmitted. We generally do not store the content of messages permanently. To the extent that any user-generated content is incidentally stored (e.g., support tickets, logs), Art. 7 DSA (hosting) applies; we act promptly to remove such content upon obtaining actual knowledge of an infringement.

3. Counter-Notice

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notice to support@pigona.com including:

  • Identification of the material that has been removed or disabled.
  • A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and email address.
  • A statement that you consent to the jurisdiction of the competent courts of Augsburg, Germany (EU/German framework), and that you will accept service of process from the person who provided the original notice.

We will review counter-notices and, where appropriate, restore the content and notify the original complainant.

4. DMCA (Courtesy for US Rightholders)

For US-based rightholders who prefer to use the DMCA process (17 U.S.C. § 512), we will voluntarily follow DMCA notice procedures as a courtesy, though our primary legal framework is EU law. DMCA notices may be sent to support@pigona.com.
